Introduction<\/h2>\n\n\n\n<p>Pinal d.o.o., Savska\nLoka 20, 4000 Kranj (hereinafter: \u201cPinal\u201d or \u201ccontroller\u201d), is dedicated to\nresponsibly handling the personal data of our clients, potential clients, Pinal\nwebsite visitors and any natural persons who reveal their personal information\nwhen contacting us (hereinafter: \u201cusers\u201d), so we are implementing this Personal\nData Protection Policy (hereinafter: \u201cPolicy\u201d) to inform our users in a\ntransparent, easy to understand way using plain language about the purpose, the\nlegal ground for the processing of their personal data and their rights\nregarding the processing, as they are afforded to them under the Personal Data\nProtection Act (ZVOP-1, Official Gazette of the Republic of Slovenia no.\n94\/2007) and the Regulation (EU) 2016\/679 of the European Parliament and\nCouncil of 27 April 2016 on the protection of natural persons with regard to\nthe processing of personal data and on the free movement of such data, and\nrepealing Directive 95\/46\/EC (hereinafter: \u201cGeneral Data Protection\nRegulation\u201d).<br>\nTerms, such as \u201ccontroller\u201d, \u201cprocessing\u201d, \u201crestriction of processing\u201d,\n\u201cprocessor\u201d, \u201cprofiling\u201d, \u201cpseudonymisation\u201d, \u201cthird party\u201d and \u201ccompany\u201d, used\nin this Policy have the meaning as stipulated in the General Data Protection\nRegulation.<br>\nIn accordance with the General Data Protection Regulation, the Policy covers\nthe following areas:<\/p>\n\n\n\n<ul><li>Contact details of the\ncontroller and of the data protection officer,<\/li><li>purposes and legal\nbasis for processing various types of users\u2019 personal data, including profiling\nthe users\u2019 personal data,<\/li><li>recipients of the\npersonal data, contractual data processing and the transfer of personal data to\nthird countries,<\/li><li>storage period for\ndifferent categories of personal data,<\/li><li>security of the\npersonal data,<\/li><li>users\u2019 rights regarding\nthe processing of their personal data,<\/li><li>procedure to exercise users\u2019\nrights regarding personal data processing,<\/li><li>the right to submit a\ncomplaint about personal data processing.<\/li><\/ul>\n\n\n\n<a name=\"ContactDetails\"><\/a>\n\n\n\n<h2>2. Contact details\nof the controller and of the data protection officer<\/h2>\n\n\n\n<p>The controller of the\nusers\u2019 personal data is Pinal d.o.o., Savska Loka 20, 4000 Kranj. Pinal has\ndesignated a data protection officer, who can be reached by e-mail at&nbsp;<a href=\"mailto:4U@collagen36.com\">4U@collagen36.com<\/a>. <\/p>\n\n\n\n<a name=\"PersonalData\"><\/a>\n\n\n\n<h2>3. Personal data<\/h2>\n\n\n\n<p>Personal data\nconstitutes any information that identifies you as an identified or\nidentifiable natural person. The user is identifiable when they can be directly\nor indirectly determined, especially using an identifier, such as the name,\nidentification number, location data, an online identifier or by stating one or\nmore factors specific to the user\u2019s physical, physiological, genetic, mental,\neconomic, cultural or social identity. In accordance with the purposes stated\nin the following chapters of the Policy, the controller collects the following\npersonal data:<\/p>\n\n\n\n<ul><li>basic information on\nthe user (full name, title, occupation and other information about the\nemployer),<\/li><li>contact information and\ninformation about the user\u2019s communication with the controller (e-mail,\ntelephone number, date, time and contents of the postal or e-mail\ncommunication, date, time and duration of phone calls),<\/li><li>channel and campaign \u2013\nmanner of gaining the user\u2019s consent or the source through which the user came\ninto contact with the controller (website and advertising campaign or\npromotion),<\/li><li>data on the user\u2019s use\nof the controller\u2019s website (dates and hours of visits to the site, visited\npages or URLs, duration of time spent on a website, number of visited pages,\ntotal time spent on the website, performed settings on the webpage) and usage\ndata on received messages (e-mail, SMS) from the controller,<\/li><li>data from voluntarily\nfilled in forms on the controller\u2019s website, e.g. for prize contests,<\/li><li>other data the user\nvoluntarily submits to the controller when requesting certain services that\ndemand such data.<\/li><\/ul>\n\n\n\n<p>The controller does not\ncollect or process the user\u2019s personal data without their expressed consent,\ni.e. when ordering products or services, subscribing to e-newsletters,\nparticipating in a prize contest etc., when there is a legal basis for the\ncollection of the personal data, the processing is necessary to execute\ncontractual obligations or when the processing is necessary for legitimate\ninterested pursued by the controller (hereinafter: \u201clegitimate interest\u201d).<\/p>\n\n\n\n<a name=\"BasisForProcessing\"><\/a>\n\n\n\n<h2>4. Basis for\nprocessing and purpose of processing<\/h2>\n\n\n\n<p>Pinal will process your\npersonal data for one of the purposes listed below based on the following legal\nbasis:<\/p>\n\n\n\n<ul><li>your agreement or\nconsent,<\/li><li>for compliance with the\nlegal obligations of the controller,<\/li><li>based on legitimate\ninterest,<\/li><li>for compliance with\ntheir contractual obligation.<\/li><\/ul>\n\n\n\n<p>Pinal will process your\npersonal data solely for the purposes, for which they were collected and will\nnot process them for purposes that are not compatible with the purposes, for\nwhich they were collected. Pinal collects only that personal data from the user\nthat is vital for achieving a set purpose.<\/p>\n\n\n\n<p>Processing to\nfulfil contractual obligations<\/p>\n\n\n\n<p>In certain cases,\nprocessing personal data is vital for the execution of the controller\u2019s\ncontractual obligations. If the user does not provide the necessary personal\ndata, the controller is unable to finalize a contract with the user or perform\nservices.<\/p>\n\n\n\n<p>The controller will\nprocess your personal data to perform contractual obligations for the following\npurposes:<\/p>\n\n\n\n<ul><li>business Cooperation\nAgreement,<\/li><li>carrying out activities\nstated in the cooperation agreement,<\/li><li>communicating with\ncontracting parties and other contact persons for the purposes of executing an\nactivity stated in the cooperation agreement.<\/li><\/ul>\n\n\n\n<p>Processing based\non consent or agreement<\/p>\n\n\n\n<p>Based on your written\nconsent, Pinal will process your personal data for the following purposes:<\/p>\n\n\n\n<ul><li>sending e-mails for the\npurpose of informing about training courses, new features (in standards and in\npublications), services as well as events at the controller or third person,<\/li><li>for contacting on the\nphone for the purposes of presenting professional system solutions to the user\nor employer (by prior appointment also at their location),<\/li><li>for publishing in &nbsp;media and on websites with the basic purpose\nof promoting the user,<\/li><li>for monitoring the\nuser\u2019s reading of sent e-mails, including which e-mail you opened or did not\nopen, which links you clicked (which contents you read), how long you were\nreading them or surveyed certain contents,<\/li><li>for segmenting users\nbased on the factors from the previous paragraph and for further sending\nadapted (individualized) e-mails, which means different users can receive\ne-mails with different contents for the purpose of a better (more relevant)\ninforming and achieving a higher level of response to the received e-mails,<\/li><li>for the purposes of\nanalysing the user\u2019s pattern-of-life on the website: from where the user came\nto the website (source of the traffic), for monitoring their activities on the\nwebsite, which websites they visited, which contents they downloaded or viewed,<\/li><li>for segmenting users\nbased on the facts from the previous paragraph and further sending adapted\n(individualized) messages through multichannel communication, which means\ndifferent users can receive messages with different contents for the purpose of\na better (more relevant) informing of individuals and reaching a higher level\nof user enthusiasm,<\/li><li>for all other purposes\nfor which you expressly agree in cooperating with the controller.<\/li><\/ul>\n\n\n\n<p>Any time you give\nconsent for the processing of your personal data, the consent can be withdrawn\nat&nbsp;<a href=\"mailto:my.rights@frodx.com\">4U@collagen36.com<\/a>.<\/p>\n\n\n\n<p>Processing is\nnecessary for completing Pinal legal obligations<\/p>\n\n\n\n<p>Your personal data is\nalso processed when required of us by the law. One example of such processing\nis processing your personal data for the purposes of judicial or administrative\nprocesses.<\/p>\n\n\n\n<p>Processing based\non legitimate interest for which Pinal strives<\/p>\n\n\n\n<p>The controller can also\nprocess data based on legitimate interest, except when this interest is\noverruled by interests or basic rights and freedoms of the user to whom the\npersonal data requiring data protection applies. In the case of using\nlegitimate interest, the controller\u2019s judgement always complies with the\nGeneral Data Protection Regulation.<\/p>\n\n\n\n<p>In certain cases, Pinal\ncan, for further processing of your personal data based on legitimate interest\nthat was collected based on one of the aforementioned legal basis (consent,\ncontract), implement certain safeguards for the protection of your personal\ndata, such as pseudonymisation, encryption, processing in an aggregated form\nand\/or deleting certain categories of personal data.<\/p>\n\n\n\n<p>Pinal will process your\npersonal data based on a legitimate interest for the following purposes:<\/p>\n\n\n\n<ul><li>Marketing, business and\nother technical analyses, such as analysing and determining which organizations\nthe event attendees are coming from and what functions they perform in these\norganizations, for keeping records of how many and which events a user\nattended, for keeping records of awarded receipts, certificates and licences of\nevent attendees.<\/li><li>Preventing fraud,\nensuring safety, submitting claims or defence of legal claims in court\nproceeding or administrative procedures. This allows the controller to process\nyour personal data in cases of suspicion of fraud in an appropriate and\nproportional scope for the purpose of identifying and stopping potential fraud\nand deceit and can, if appropriate, forward the data to the police, the\nProsecutor\u2019s Office or other competent authority.<\/li><li>Direct marketing,\nincluding creating user profiles, based on legally acquired personal data. The\nstated processing can be objected to in accordance with the chapter Right to\nObject in this Policy.<\/li><\/ul>\n\n\n\n<a name=\"PersonalDataRecipients\"><\/a>\n\n\n\n<h2>5. Recipients of\npersonal data, contractual data processing and transfer of personal data to\nthird countries (countries that are not members of the European Union or the\nEuropean Economic Area)<\/h2>\n\n\n\n<p>Your personal data can\nbe accessed solely by Pinal employees and authorized processers of personal\ndata.<\/p>\n\n\n\n<p>Pinal will never\nforward your personal data to unauthorized third persons.<\/p>\n\n\n\n<p>By using Pinal websites\nand other services, you agree that Pinal may entrust individual tasks about\nyour personal data to its authorized processers of personal data. The listed\nprocessers can process your personal data exclusively in the name and in\naccordance with Pinal\u2019 written instructions, within the limits of the\nauthorization, as stated in the agreement between Pinal and the processor, and\nin accordance with the purposes as stated in the Policy. The processors of your\npersonal data may under no circumstances use your personal data to pursue any\nkind of personal interest.<\/p>\n\n\n\n<ul><li>The FrodX d.o.o. company, Celov\u0161ka cesta 280, 1000\n     Ljubljana, has contracts with Pinal for the purposes of performing digital\n     marketing activities and information system maintenance: Business\n     Cooperation Agreement, Data Protection Agreement and Data Processing\n     Agreement.<\/li><\/ul>\n\n\n\n<a name=\"StoragePeriod\"><\/a>\n\n\n\n<h2>6. Personal data\nstorage period<\/h2>\n\n\n\n<p>The controller will not\nprocess personal data longer than necessary to achieve the purposes for which\nthe personal data was collected and further processed.<\/p>\n\n\n\n<p>The personal data\nprocessed by Pinal is processed in compliance with the agreement and is stored\nby Pinal for the period that is necessary to complete the contract and for 5\nyears after its completion, except in cases when a disagreement arises about\nthe contract between you and the controller. In that case, Pinal keeps that\ndata for 5 years after the finalized court judgements or arbitration decisions\nor settlement, or in the case of no litigation, for 5 years after the dispute\nhas been resolved peacefully.<\/p>\n\n\n\n<p>The personal data\nprocessed by Pinal based on the law is stored by Pinal for the legally\ndetermined duration of time.<\/p>\n\n\n\n<p>The personal data\nprocessed by the controller based on your personal consent or legitimate\ninterest are kept by Pinal permanently until you withdraw your consent or\nsubmit a request that the processing be terminated. Pinal will delete such data\nbefore they are withdrawn only if the purpose of the processing of the personal\ndata has been achieved or if it is determined by the law.<\/p>\n\n\n\n<p>After the storage\nduration period has elapsed, Pinal will effectively and permanently delete or\nanonymize your personal data so that it can no longer be traced back to you.<\/p>\n\n\n\n<a name=\"DataProtection\"><\/a>\n\n\n\n<h2>7. Personal data\nprotection<\/h2>\n\n\n\n<p><strong>Pinal is dedicated to\nprotecting your personal data. They prevent any unauthorized access to it,\ntheir use and their revelation with the following measures:<\/strong><\/p>\n\n\n\n<ul><li>The data is protected\nwith the workspace, equipment and system software, including input-output\nunits.<\/li><li>The data is protected\nby application software that is used for processing personal data.<\/li><li>Pinal prevents\nunauthorized access to personal data during their transfer, including\nforwarding using telecommunication means and networks.<\/li><li>Pinal enables an\neffective way of blocking, destroying, deleting or anonimizing personal data\nafter the purpose, for which they were collected, ceases.<\/li><li>Pinal enables later detection\nof when individual data that had been entered into the personal data database\nwere used, forwarded or otherwise processed and by whom.<\/li><\/ul>\n\n\n\n<p><strong>Unauthorized access to\npersonal data, their use and revelation is prevented by Pinal with the\nfollowing safety technologies and procedures:<\/strong><\/p>\n\n\n\n<ul><li>controlling physical\naccess,<\/li><li>locking rooms, closets,\ncomputers,<\/li><li>storing carriers of\npersonal data in secured rooms,<\/li><li>preventing office\nmaintenance workers, clients and other visitors of the controller\u2019s offices\nfrom having any consultation with the personal data,<\/li><li>preventing password use\nto persons who have not been directly assigned to the stated purpose,<\/li><li>limiting data transfer\nby the employees,<\/li><li>controlling the number\nof copies and data transfer,<\/li><li>limiting, documenting\nand securing the transfer of the data through telecommunication networks,<\/li><li>preventing insight into\nthe data to persons whose employment contract has been terminated,<\/li><li>strictly separating\ntheir data from the data of any other possible controllers.<\/li><\/ul>\n\n\n\n<a name=\"UserRights\"><\/a>\n\n\n\n<h2>&nbsp;8. Users\u2019\nrights in personal data protection<\/h2>\n\n\n\n<p>In accordance with the\nGeneral Data Protection Regulation, Pinal guarantees you the following rights\nrelating to personal data protection, which are further elaborated in the\nfollowing chapters of the Policy:<\/p>\n\n\n\n<ul><li>right of access to the\ndata,<\/li><li>right to rectification,<\/li><li>right to erasure\n(\u201cright to be forgotten\u201d),<\/li><li>right to restriction of\nprocessing,<\/li><li>right to data\nportability,<\/li><li>right to object.<\/li><\/ul>\n\n\n\n<p>Right of access to\nthe data<\/p>\n\n\n\n<p>You have the right to\nobtain confirmation from Pinal as to whether or not they are processing your\npersonal data, and, where that is the case, you have the right to access your\npersonal data and the following information about personal data processing:<\/p>\n\n\n\n<ul><li>the purposes of the\nprocessing,<\/li><li>the categories of\npersonal data,<\/li><li>the recipients or\ncategories of recipient to whom the personal data have been or will be\ndisclosed, in particular recipients in third countries or international\norganisations,<\/li><li>where possible, the\nenvisaged period for which the personal data will be stored, or, if not\npossible, the criteria used to determine that period,<\/li><li>the existence of the\nright to request from the controller rectification or erasure of personal data\nor restriction of processing of personal data concerning the user or to object\nto such processing,<\/li><li>the right to lodge a\ncomplaint with a supervisory authority,<\/li><li>where the personal data\nare not collected from the user, any available information as to their source,<\/li><li>the existence of automated\ndecision-making, including profiling, and meaningful information about the\nreasons for it, as well as the significance and the envisaged consequences of\nsuch processing for the user.<\/li><\/ul>\n\n\n\n<p>Based on your request, Pinal\nwill provide you with a free copy of your personal data undergoing processing.\nFor any further copies you request, Pinal will charge a reasonable fee based on\nadministrative costs.<\/p>\n\n\n\n<p>Right to\nrectification<\/p>\n\n\n\n<p>You have the right to\nobtain from Pinal without undue delay the rectification of inaccurate personal\ndata concerning you. Taking into account the purposes of the processing, you\nhave the right to have incomplete personal data completed, including by means\nof providing a supplementary statement.<\/p>\n\n\n\n<p><strong>Right to erasure\n(\u201cright to be forgotten\u201d)<\/strong><\/p>\n\n\n\n<p>You have the right to\nobtain from Pinal the erasure of personal data concerning you without undue\ndelay and Pinal shall have the obligation to erase your personal data without\nundue delay where one of the following grounds applies:<\/p>\n\n\n\n<ul><li>the personal data are\nno longer necessary in relation to the purposes for which they were collected\nor otherwise processed,<\/li><li>you withdraw consent on\nwhich the processing is based, and where there is no other legal ground for the\nprocessing,<\/li><li>you object to the\nprocessing pursuant the controller\u2019s legitimate interest and there are no\noverriding legitimate grounds for the processing,<\/li><li>you object to the\nprocessing for the purposes of direct marketing,<\/li><li>the personal data have\nto be erased for compliance with a legal obligation in accordance with EU or\nSlovenian State law.<\/li><\/ul>\n\n\n\n<p>Where Pinal has acted\nin accordance with the Policy and has made your personal data public, Pinal\nshall take reasonable steps, including technical measures, to inform\ncontrollers which are processing the personal data that the user has requested\nthe erasure of any links to, or copy or replication of those personal data.<\/p>\n\n\n\n<p><strong>Right to restriction of\nprocessing<\/strong><\/p>\n\n\n\n<p>You have the right to\nobtain from Pinal the restriction of processing of your personal data where one\nof the following applies:<\/p>\n\n\n\n<ul><li>You contest the\naccuracy of the personal data, for a period enabling the controller to verify\nthe accuracy of your personal data.<\/li><li>The processing is\nunlawful and you oppose the erasure of the personal data and request the\nrestriction of their use instead.<\/li><li>When Pinal no longer\nneeds the personal data for the purposes of the processing, but you required\nthem for the establishment, exercise or defense of legal claims.<\/li><li>You have objected to\nprocessing, pending the verification whether the legitimate grounds of the\ncontroller override yours.<\/li><\/ul>\n\n\n\n<p><strong>Right to data\nportability:&nbsp;<\/strong><br>\nYou have the right to receive personal data concerning you, provided by Pinal,\nin a structured, commonly used and machine-readable format and have the right\nto transmit those data to another controller without hindrance from Pinal to\nwhich the personal data have been provided, when:<\/p>\n\n\n\n<ul><li>the processing is based\non consent or agreement, and<\/li><li>the processing is\ncarried out by automated means.<\/li><\/ul>\n\n\n\n<p><strong>Right to object<\/strong><br>\nOn grounds relating to your particular situation, you have the right to object,\nat any time to processing of your personal data, if your objection is based on\nlegitimate interests pursued by Pinal or a third party. Pinal shall no longer\nprocess the personal data unless they demonstrate compelling legitimate grounds\nfor the processing which override your interests, rights and freedoms or for\nthe establishment, exercise or defense of legal claims. Where personal data are\nprocessed for direct marketing purposes, you have the right to object at any\ntime to processing of your personal data for such marketing, which includes\nprofiling to the extent that it is related to such direct marketing. If the\ndirect marketing is based on consent, the right to object can also be achieved\nby withdrawing the personal consent.<\/p>\n\n\n\n<a name=\"Procedure\"><\/a>\n\n\n\n<h2>9. Procedure to\nexercise rights<\/h2>\n\n\n\n<p>All the aforementioned\nclaims on exercising rights regarding your personal data can be addressed in\nwritten form to the controller at the e-mail address&nbsp;<a href=\"mailto:my.rights@frodx.com\">4U@collagen36.com<\/a>&nbsp;or by post to the\naddress Pinal d.o.o., Savska Loka 20, 4000 Kranj, Slovenia.<\/p>\n\n\n\n<p><br>\nIf you submit your claim, in accordance with the previous paragraph, using\nelectronic means, the information, where possible, will be provided to you in\nelectronic means, unless you request otherwise.<\/p>\n\n\n\n<p>The controller can, for\nthe purposes of reliable identification in cases of claiming rights on personal\ndata, request additional information from you that is necessary to confirm your\nidentity, and may decline acting in accordance with this chapter only in the\nevent that they cannot reliably identify you.<\/p>\n\n\n\n<p>The controller will\nrespond to your request exercising your rights regarding your personal data\nwithout undue delay in no more than a month after receiving the claim. Pinal\ncan extend the deadline to comply with the rights for no more than two\nadditional months, taking into account the complexity and number of claims. If Pinal\nextends the deadline, they will inform you about the extension within one month\nof receiving the claim, including the reasons for the delay.<\/p>\n\n\n\n<p>If your claims\nregarding this chapter are obviously unfounded or excessive, especially when\nrepetitive, Pinal can:<\/p>\n\n\n\n<ul><li>charge a reasonable fee\nbased on administrative costs of forwarding the information or the claim or of\nprocessing the claim,<\/li><li>decline to act on the\nclaim.<\/li><\/ul>\n\n\n\n<a name=\"ComplaintRight\"><\/a>\n\n\n\n<h2>10.
